Prohibited Use Policy

This Prohibited Use Policy (“Policy”) supplements the Giga Terms of Service (“Terms”) and applies to Customer's and its Authorized Users' and End Users' access to and use of the Giga Platform and Giga Services, including any Customer Materials submitted or generated in connection with that use. Capitalized terms used but not defined in this Policy have the meanings given to them in the Terms.
“End User” shall mean an individual who interacts with an AI agent or workflow that Customer has built or deployed using the Giga Platform, such as a customer of Customer's business.
Prohibited Uses
1. Do not engage in illegal behavior.
For example, this includes using the Giga Platform or Giga Services to:
- a) Infringe, misappropriate, or otherwise violate Giga’s or a third party's intellectual property or privacy rights.
- b) Create or facilitate the exchange of illegal goods or services, including but not limited to illegal drugs, weapons, counterfeit goods, or human trafficking.
2. Do not use the Giga Platform in ways that may significantly affect the wellbeing of others.
For example, this includes using an AI agent built on the Giga Platform to:
- a) provide tailored financial, legal, or health/medical advice to an End User without (i) a qualified professional reviewing the relevant Output before an End User relies on it, and (ii) clear disclosure of the use and limitations of AI.
- b) engage in debt collection communications that are harassing, threatening, or otherwise non-compliant with applicable debt-collection law.
- c) make high-stakes automated decisions affecting an individual's employment, credit, housing, insurance, or benefits eligibility without meaningful human review.
- d) market or advise on regulated goods or services including controlled substances, prescription medications, or firearms without Giga's prior written authorization.
To request authorization under this Section 3, contact legal@giga.ai. Customer remains responsible for ensuring its use complies with applicable law.
3. Do not engage in fraudulent, predatory, or abusive practices.
For example, this includes using the Giga Platform or Giga Services to:
- a) place calls or send messages using an automated dialing system or artificial/prerecorded voice to an individual without the consent or legal basis required under the Telephone Consumer Protection Act (TCPA) or comparable state, Federal or Regional law(s).
- b) manipulate or deceive End Users in a manner likely to cause harm, including attempts to obtain sensitive information such as payment card numbers, government identifiers, or health data under false pretenses.
- c) generate or facilitate spam, or engage in call or message volumes designed to overwhelm or disrupt a recipient's systems.
- d) evade or circumvent consent, opt-out, or do-not-call mechanisms required by applicable law or by Giga.
4. Do not engage in unauthorized or deceptive impersonation.
For example, this includes using synthetic or recorded voice technology in a manner intended to deceive an End User about whether they are interacting with a human.
5. Do not engage in voter suppression, candidate impersonation, or political campaigning.
For example, this includes using the Giga Platform or Giga Services to contact individuals for the purpose of political campaigning, election-related solicitation, or impersonating a political candidate or government official.
6. Do not threaten the security, availability, or integrity of any network or system.
For example, this includes attempting to gain unauthorized access to computer systems, or using the Giga Platform to facilitate malware, unauthorized surveillance, or disruption of critical infrastructure.
7. Do not create violent, hateful, or harassing material outside fictional or newsworthy contexts.
For example, this includes using the Giga Platform or Giga Services to threaten or incite violence, discriminate based on a protected characteristic, promote self-harm, or spread misinformation, including medical misinformation.
8. Do not threaten child safety.
For example, this includes using the Giga Platform or Giga Services to:
- a) create, distribute, or facilitate sexually explicit material involving minors, or otherwise facilitate the exploitation or sexualization of children. Giga will report all apparent child abuse material to the relevant authorities where required by law.
- b) target minors with age-inappropriate material, including sexual content, graphic violence, or other mature themes.
- c) facilitate cyberbullying, harassment, or exploitation of any minor.
9. Do not use the Giga Platform contrary to Giga's policies or purpose.
For example, this includes:
- a) reselling, sublicensing, or making the Giga Platform available to a third party other than through a properly disclosed end user agreement, as described in the Terms.
- b) making the Giga Platform available to your End Users on terms less protective of those End Users than the terms under which Giga makes the Platform available to you.
- c) reverse engineering, decompiling, or attempting to derive the source code, models, weights, or parameters underlying the Giga Platform.
- d) using the Giga Platform, or any Output generated through it, to develop, train, or benchmark a product or service that directly or indirectly competes with Giga.
- e) scraping, data-mining, or extracting data from the Giga Platform other than through Giga's supported APIs.
- f) making the Giga Platform available to, or using it on behalf of, a government entity without Giga's prior written authorization.
- g) using the Giga Platform in a manner classified as “prohibited” or “high-risk” under applicable AI-specific law, including the EU Artificial Intelligence Act (Regulation (EU) 2024/1689), where applicable. As a deployer of AI agents built on the Giga Platform, Customer is responsible for its own classification and compliance analysis under such laws.
Other Requirements
1. Disclosure
Customer must clearly and prominently disclose to its End Users that they are interacting with an AI-powered system rather than a human, consistent with the Consumer Recording Notice and AI-disclosure obligations set out in the Terms and the applicable Commercial Contract governing the use of Giga’s platform.
2. Human in the Loop
As provided in Section 3 above, any use of the Giga Platform to provide tailored professional advice requires a qualified professional to review the relevant Output before an End User relies on it.
Enforcement
Enforcement of this Policy is at Giga's sole discretion. Giga's failure to enforce this Policy in a given instance does not waive its right to enforce it in other instances. Giga uses a combination of automated systems, user reports, and human review to assess activity that may violate this Policy. Where Customer's use violates this Policy, Giga may suspend or restrict access to the Giga Platform, and for activity posing a real risk of harm, Giga may contact or cooperate with relevant law enforcement authorities. Updates to This Policy
Giga may update this Policy from time to time. We will provide notice of material changes consistent with the Terms. The “Last Updated” date above reflects the most recent revision.
